“It is a universally accepted principle that a person may protect themselves from harm under appropriate circumstances” Each state has its own laws and everyone should know the laws in the jurisdiction they reside. Don’t assume you know the laws.

This link is a summary of the basic concepts of self-defense law in the USA.

    http://criminal.findlaw.com/criminal-law-basics/self-defense-overview.html

If you carry a gun you must know the laws, again each state is different.

Thanks so much for sharing these, 74!
Great info for everyone to know, especially when traveling between states.

It shocked me during my recent OK CCW course: In this state, I cannot defend anyone other than my immediate family, employee (!) or employer (:p) Even grandchildren are not covered. If I see someone getting beaten or raped or threatened with a firearm, I cannot come to their aid. They are changing some laws as we speak, but this is ridiculous.

The instructor gave us a way around the grandchild thing, however: Your presence is Threat Level One (LE Scale). If I step near the incident and protest vocally (no threats) and the attention is diverted toward me, if it is considered an assault (verbal threats with apparent ability to carry them out), I may defend MYSELF. Legal weirdness…. That’s why lawyers are rich…

    Wild,
    (Look this up)
Even though you are restricted from using deadly force in your senerio, most states allow reasonable use of force. So you don’t have to stand there watching. The chair in the room might be a usefull weapon or some other club like item. Then if he turns toward you to attack you have reasonable cause. Like I said before, look it up.

In PA you cannot protect property so if your car is being stolen it is not reasonable/lawful to shoot. However you can use resonable force like a punch to the face.

True, we are not legally allowed to shoot to protect property either, in OK. Thanks for the other thoughts on reasonable force…true, a chair, club, etc. But if the aggressor is armed–even with a club or crowbar–or young and strong, I do have my age and sex on my side. (71 yr old female.) There are times when “equality” goes out the window, because it isn’t factual anyway. The instructor said I must do what I can to stop the attack. My thoughts exactly.

I would rather be tried for their murder than they be tried for my murder!

AZ is pretty liberal about self defense , good to know . The Peoples Republik of Kalifornia , and the Soviet Socialist Republik of New York , seem to be fighting for the bottom rung of the freedom ladder .

Most places have a clause in the self defense statutes that relates to imminent death or serious bodily injury (SBI) which can potentially be lethal.

The ER doctors I have talked with in a number of cases accepted that a broken nose is potentially lethal. (Brain damage or other traumatic head injury)
A broken bone is potentially lethal. (blood clot)
    Etc.

So much depends on how you word what happened.

Me, I have a back injury.
I can’t fight anymore, it ‘could’ potentially leave me paralyzed.
I have doctors reports that can show that also.
I can articulate my fear of imminent death or SBI before I fire that shot quite easily.

Depending on where you are, you can generally defend oneself, family and others from the same, imminent death and/or SBI. And yes, rape would be considered SBI.

Legal weirdness…. That’s why lawyers are rich… Despised you mean.

This is another big win for gun owners!

“In a January 10th ruling, the U.S. District Court for the District of Idaho struck down a ban on the possession “of a firearm and other arms” on Army Corps of Engineers-controlled land.”

People with small business establishments are getting guns for self defense. They’re being robbed like crazy. Also people are being shot frequently on the street. A girl in a park here was shot in the head by someone in a vehicle 300 feet away. She’s dead. Mother of two kids… dead. These are mostly black crimes. Its impossible to keep track of all the people defending themselves. People involved in shootings are shutting up. They’re not calling the cops and if they go to the hospital it becomes a drive by or accident. The twisted legal system will make anyone they can get their hands on into an assailant if you volunteer. Don’t be a volunteer.
